Calhoun resident Brian Edward Rush has entered into a plea agreement with the
Calhoun Circuit Court. Rush had been found guilty of sexual assault in the third
degree involving a minor.
Judge Thomas Evans III suspended a harsher sentence, indicating the public
interest does not require the defendant to be incarcerated, and that it is unlikely
the defendant will commit this offense again.
The court placed Rush on probation for five years with at least twenty stipulations
he must follow, otherwise probation will be revoked.
Conditions include counseling, 100 hours of community service, 20 hours of litter
control, the payment of court costs, no association with the victim or any female
under the age of 18, register as a sex offender, no use of alcohol or illegal controlled
substances, submission to drug tests, among others.
