Defense motions were filed this week in Glenville on behalf of Glenville's former
town policeman Sgt. Michael Kendall, whose case is set for trial on October 15.
Multiple felony charges have been filed against Kendall following a high-speed
chase on March 7 with Kevin Tingler, 20, where the officer fired a gunshot through
Tingler's truck. The officer then proceeded to go to Tingler's family residence
where he "entered the house with his gun pulled," according to the charges.
Tingler was not present.
The motions in Gilmer Circuit Court are to stop the state from offering evidence
from Kendall's personnel file from the City of Clarksburg, a change of venue, and the
dismissal of the kidnapping charges against Kendall.
The City of Clarksburg has indicated Kendall separated from their police
department because of alleged problems he experienced while employed there.
Kendall's attorney Gerald Jones said such information would prejudice the case
against his client.
Officer Kendall suspected Tingler of driving under the influence of alcohol.
Kendall claims Tingler tried to run over him, causing him to fire his weapon. A State
Police forensic examination of Tingler's truck will likely provide important evidence
in the case.
Sgt. Kendall was dismissed by the Glenville town council.
