ATTEMPTED MURDER HEARING CONTINUED - Stutler's Bond Terms Clarified

A hearing for Little Creek resident Harold Stutler, 66, set for yesterday was continued until September 4th at 1 p.m. in Calhoun Magistrate's Court.

Stutler is charged with the attempted first degree murder and malicious wounding of his brother-in-law and nearby neighbor, Richard Starcher.

He was released from Central Regional Jail last week on $100,000 bond.

Stutler made a brief appearance in Magistrate Postalwait's court with his attorney Tony Morgan, while Starcher and several members of his family waited in the hallway to hear about today's proceedings.

Calhoun County Prosecuting Attorney Matt Minney said the non-monetary terms of Stutler's bond were "slightly changed". Postalwait said the change more clearly offers a definition of contact between Stutler and Starcher, using other parties or the sending of messages.

Communication regarding an ongoing civil dispute between Stutler and Starcher, according to the court, should be made through their attorneys.

Stutler turned himself in to Sheriff Allen Parsons last Tuesday after an ambush-style shooting Monday night in a remote area southeast of Creston.

Stutler allegedly waited along the road bank on the Ace Haney Hill for Starcher to drive by, blasting away at his vehicle as it climbed the steep roadway.

Starcher received injuries after three or four shotgun blasts struck his pick-up truck.

There were indications that a shotgun blast went through the open driver's window, with a shot striking the mirror, and another shot shattering the rear window of the truck. It appeared that two other shots hit the truck bed body as Starcher's truck sped away. (See earlier Hur Herald story)

Starcher was treated and released at Minnie Hamilton Health Care Center.

The civil disagreement is over a small strip of property which Stutler claims he owns and is utilized by Starcher . The brothers-in-law have been at odds for over a year regarding their land rights.
