Multiple officers from the State Police, the Calhoun Sheriffs Department and the Grantsville Police Department arrested Brian Lee Smith, 36, on Cain Road Tuesday night, after it was discovered that Smith was released from a Charleston hospital, reportedly being released with failure to notify law enforcement.
Smith had been facing numerous charges related to earlier incidents in Calhoun when he resisted arrest, brandished a knife on officers and was shot.
Smith had returned to Cain Road where his domicile burned on May 31 and was sleeping in a tent.
Officers said he was safely apprehended, while Calhoun EMS was called to treat him after reportedly being sprayed with chemical maze.
Smith is facing charges for attempted murder, assault on a government official, fleeing from an officer, obstructing an officer, driving suspended, and DUI controlled substance.
He is in Central Regional Jail where bond has been set at $225,036.
CALHOUN MAN WHO ATTACKS OFFICERS WITH KNIFE AND WAS SHOT, IMPROVING
UPDATE 5/15/2019 - A Calhoun man, Brian Lee Smith, 36, is reportedly improving from injuries after he was tased and shot by Calhoun law enforcement.
He has been listed in critical condition in a Charleston hospital.
State Police and the Calhoun Sheriffs Department were attempting to serve a warrant for a second time at his Cain Road residence when the incident happened.
During an earlier attempt to serve a warrant, Smith brandished a knife and fled.
Following an investigation by the West Virginia State Police, Calhoun Deputy C. J. Myers was cleared and has returned to work.
There was reportedly an eyewitness to the incident.
Smith is facing numerous charges, failure to appear for DUI, driving suspended, obstructing, fleeing and assault on a government employee.
CALHOUN MAN ATTACKS OFFICERS WITH KNIFE - Officers Tase And Shoot Smith
UPDATE 5/7/2019 - A second attempt to serve a warrant on Brian Lee Smith, 36, on Cain Road Monday evening, ended with police officers tasing him and when that didn't stop him, shooting him was necessary for the officer's safety, police said.
 Smith was airlifted to a medical center with wounds to his abdomen and right arm. He is in critical condition.
Deputy C. J. Myers of the Calhoun Sheriffs Department shot Smith after he pulled a knife on the officers and Trooper B. E. Young had used a taser on him with minimal results, according to Sheriff Jeff Starcher.
"He kept advancing when the deputy fired," said Sheriff Starcher.
Last week, Smith brandished a knife on Deputy Myers while attempting to serve a warrant, then running into woods. Deputies were trying to serve a warrant on him for failure to appear for DUI and driving suspended.
Monday, the additional warrants were for obstructing, fleeing and assault on a government employee from that incident.
Myers was placed on administrative leave with pay pending the outcome of the investigation.
1st Sgt. J. C. Saurino of the State Police is investigating the case.
CAIN ROAD MAN SMITH SHOT IN CONFRONTATION WITH LAW ENFORCEMENT SERVING WARRANT - Last Week Smith Brandished A Knife On Deputy Sheriff, Fleeing Into Woods

A Cain Road man was shot Monday evening during a confrontation with law enforcement.
He has been identified as Brian Lee Smith, 36.
Reportedly a Calhoun Sheriffs Deputy and a State Policeman went to the location to serve a warrant on the man in a rural area off Norman Ridge.
911 reported shots fired at 5:30 p.m.
A number of State Police units responded to the scene.
Calhoun EMS reported to the scene and transported the man to a Big Bend landing zone, after which he was air-lifted to a medical center.
The man was reportedly shot in the abdomen and right arm.
Last week, Sheriff's deputy C. J. Myers was attempting to serve Smith with a warrant, when Smith brandished a knife on the officer and ran into the woods.
Calhoun Sheriff Jeff Starcher said, related to this incident, Deputy C. J. Myers was being placed on administrative leave with pay pending the outcome of the investigation.
The Grantsville Fire Department responded for assistance.
The incident happened a short distance from the location that Eugene Stevens was murdered in 2017.
State Police were at the scene investigating the shooting for four hours.
