STATE WATER OWNERSHIP GOING ABROAD - Settlement Reached

(01/03/2003)
A settlement has been reached between the state Attorney General, clearing the way for the sale of West Virginia water companies to a German conglomerate.

State Attorney General Darrell McGraw says today's agreement with West Virginia-American Water Company protects Charleston's citizens.

The state's Public Service Commission will review McGraw's agreement, which includes seven sections.

. The local company must gain approval from the PSC before selling water out of state and must contribute 3 percent of its gross revenue from future water sales out of the state. The company also cannot use international treaties to challenge the PSC's jurisdiction and must pass along any savings from the sale to customers, among other considerations.
