ULLUM'S ETHICS COMPLAINT AGAINST CALHOUN COMMISSIONER DISMISSED

The WV Ethics Commission dismissed a complaint filed by Calhoun businessman Tom Ullum against Calhoun commissioner Bob Weaver.

Ullum's complaint, while containing a number of issues of his concern, was based on commissioner Weaver invoking Roberts Rules of Order, related to Ullum interrupting the due process of the commission meeting.

Ullum at times issued questions and asked for replies to individuals attending the meeting, in addition to asking questions of commissioners during the meetings.

Weaver advised Ullum that he had consistently been given time during meetings to express his concerns, and would not be permitted to disrupt meetings at will, a violation of Roberts Rules of Order.

Ullum, during more than one meeting, continued to violate the open meetings rules, making statements and asking questions.

Ullum's ethics complaint said that "(Weaver) even went to the point of going to have me removed by the sheriff."

Commission president Chip Westfall said, "We did investigate and take action regarding Mr. Ullum's concerns, and most certainly acknowledged his rights as a citizen to present his concerns at meetings."

The Ethics Commission, in a response, said Ullum's allegations against Weaver did not constitute a material violation of the Ethics Act, and the complaint was dismissed.
