A Ritchie County teacher Pete Weekley has been cleared of all sexual abuse charges filed against him.
The case was plagued with evidence problems, including testimony that a state trooper ordered one or more students to delete cell phone information reportedly pertinent to the case.
Weekley's attorney Judith McCullough said in her 15 years of practice she had never seen such an egregious case, including the police not interviewing Weekley about the alleged crime.
"The investigating officer, West Virginia State Police Cpl. Brewer, testified before the Grand Jury in this matter. His testimony contained numerous false statements regarding the evidence in this case. These false statements were verified by information contained in the State's Discovery in this case," McCullough said.
McCullough said jurors who found him not guilty approached him following the verdict expressing their concerns after a 19-month ordeal.
Prosecuting Attorney Jones said he would not discuss the reasons for an earlier dismissal and then a re-instatement of charges.
Jones said he was disappointed with the jury's verdict, but that "It's something we'll have to live with."
