CALHOUN CIRCUIT COURT PROCESSES LARGE CASELOAD

Calhoun Circuit Court was in session this week, with Judge Thomas Evans III and Judge David W. Nibert presiding.

Justin Hannah failed to appear for arraignment on his recent indictment for forgery and uttering. A bench warrant was issued for his arrest, according to prosecutor Shannon Johnson.

Brian Smith's trial regarding malicious assault and sexual assault in the second degree was continued and set for trial on October 6th.

Joseph Kute's trial for malicious assault and battery was continued until October 6th.

Orville Doolittle's trial for sexual abuse by a parent or guardian, and Incest was continued until December 8th.

Gary Johnson's trial regarding his felony charge of manufacturing marijuana was continued and set for a scheduling conference on August 10th.

Danny Lockhart's trials involving the manufacture of marijuana and sexual assault were continued and will come on for a scheduling conference on August 10th.

Gary Ferrell's trial on charges of delivery of a controlled substance was continued for a scheduling conference on August 10th.

Matthew Jeffrey's counsel announced that he had accepted a plea agreement from the state, but that he was not ready to enter the plea at this time. His case was set for entry of that plea on July 2nd.

Prosecutor Johnson said Charles Norman was sentenced to three years supervised probation for his conviction of conspiracy to operate a clandestine methamphetamine drug laboratory, a felony, with a plea of no contest to delivery of a controlled substance, a felony.

Norman was ordered to pay the costs of the proceedings and ordered to pay $5.00 per month community corrections fee and $5.00 per month supervised probation fees. He was also ordered to complete an outpatient rehabilitation treatment program.

Leon Kerby's sentencing for child abuse resulting in injury, a misdemeanor, was continued to July 23rd.

Christopher Lamp's sentencing for unlawful assault was continued to August 4th.

Joshua Slider's sentencing for operating a clandestine methamphetamine drug laboratory, a felony, was continued to July 23rd.

Joshawa Whipkey's trial for possession of precursors for the manufacture of methamphetamine was continued to August 17th for a pre-trial hearing and scheduling. Allen Nelson, Jrs, trial for malicious assault and destruction of property was continued until August 17th for a status hearing so that the defendant may undergo a competency and criminal responsibility evaluation.

Cindy McCune and Dennis McCune's case involving operation of a clandestine methamphetamine drug laboratory was continued to July 21 for trial.

February Michelle Williams's trial for embezzlement was continued to August 4th.

Jeremy Todd Saunder's trial for sexual abuse by a parent, guardian or custodian was continued to September 15th.

David Lee Carpenter and Jeffrey Radabaugh's trial was continued to July 21st for entry of a plea agreement.

The next court date is July 2, with Judge Thomas Evans presiding.
