UPDATE - Jason Rollyson, 31, of Frametown, Braxton County, appeared in court Thursday on charges related to photographing a boy in a restroom at a Big Otter convenience store.
During the hearing, Rollyson's felony charge of "use of minors in filming sexually explicit conduct" was dropped.
According to prosecutor Dan Dotson, the way the law reads, the child has to be engaged in a sexual act for the charge to stick, and using the bathroom doesn't count as a sexual act.
Dotson said Rollyson is still facing misdemeanor charges in connection with the crime. He is being held at Central Regional Jail, with his bond dropped from $220,000 to $20,000 cash only.
4/11/2015 - A Frametown, Braxton County man accused of taking pictures of a young boy while he was in the restroom at a Big Otter gas station in Clay County in March was arrested Thursday.
According to a criminal complaint, Jason Rollyson, 31, of Frametown, is charged with prohibited acts, porn, filming/photographing a minor.
The complaint says the 9 year-old-boy said he went to the bathroom at the Exxon in Big Otter on March 9. He told police that while he was in there, a man came in and took pictures of him with a cell phone while his pants were down and he was sitting on the toilet.
Officers say after they got the information, they went to the gas station and got surveillance video that showed the boy going into the bathroom and a man walking in just a few minutes later.
According to the complaint, police were given information from the public after camera surveillance was issued to the media that identified the man as Rollyson.
Police say Rollyson later admitted that he was in the restroom and took pictures of the young boy.
Rollyson is in Central Regional Jail with bond posted at $220,000.
UPDATE 3/21/15 - State Police are reporting Friday that a suspect being sought for allegedly photographing a youth in a restroom at the Big Otter Exxon station has turned himself into authorities. No other details are available.
Police have not commented on details of the incident, except what the youth reported to parents.

Troopers need help identifying the man who young boy says took photos of him in restroom

BIG OTTER, WEST VIRGINIA - Troopers need your help identifying a man who a young boy said took photos of him using the restroom in Big Otter, West Virginia. It happened on Monday, March 9 around 5 p.m., according to troopers with the West Virginia State Police.
Troopers said the the boy, his grandmother and brother entered the Exxon, and shortly afterwards the boy said he needed to use the restroom. He was in the restroom for about five minutes, when surveillance video shows the suspect entering the same restroom.
Troopers said the boy's grandmother knocked on the door to ask if he was okay. The boy said he needed toilet paper. At that point, the suspect walked out of the bathroom. His grandmother asked the suspect to hand the boy some toilet paper under the stall. The suspect looked at the grandmother, smirked, and immediately walked to his truck and left, troopers said.
Shortly afterwards, the boy, his brother and grandmother walked outside to their car. The boy began to cry, troopers said. His grandmother asked what was wrong ...
