The case against a Calhoun man Ordie Rogers, Jr., 30, related to charges against him for his part in the death of his infant daughter 2-month-old Darlene Rogers, is being dismissed by Judge Thomas Evans III.
The execution of the order of the actual dismissal has been stayed until January 17, 2013 until after the Grand Jury meets, which indicates charges could be refiled.
Judge Evans said the dismissal is related to problems that happened during the presentment of charges against Rogers during the previous Grand Jury.
The charges against Rogers could be refiled.
Rogers had been indicted on one count of murder in the 2nd degree and one count of child neglect resulting in death.
Ashley Kreh, 21, Rogers' significant other and the mother of the deceased child, has entered into a plea agreement in the murder case and is scheduled for sentencing on Feb. 25. 2013.
Kreh has been indicted on one count of murder in the 2nd degree and one count of child abuse resulting in death. She is currently in Central Regional Jail on $750,000 bond.
