MAGISTRATE JOHNSON'S CASE POSTPONED - Will Be Rescheduled

A case against former Calhoun Magistrate Steve Johnson was on the Calhoun Circuit Court docket for Monday, July 29 at 9:30 a.m., but the session was canceled late Friday by Judge David Nibert, who is presiding over a murder trial in another county.

The appearance Monday was to have been a "plea on information," or issues related to plea bargaining, in this case indicating Johnson may have agreed to plead to certain charges.

No indictment has been brought against Johnson, although the Supreme Court appears to be pressing the case.

Johnson resigned his magistrate's position in October, 2001 after the West Virginia Supreme Court began an investigation into alleged office irregularities. Johnson then moved to South Carolina.

An audit of Johnson's financial practices by the West Virginia State Auditor reportedly indicates missing and misappropriated funds of a few thousand dollars.

Special prosecutor Rob Schulenberg from Kanawha County is representing the State of West Virginia and attorney David Karickhoff is representing Johnson.

The pending Supreme Court case against Johnson is reportedly for embezzlement.
