Judge David Nibert ruled against probation for Sammie Dale Hall in a case before
Calhoun Circuit Court this week, although a plea agreement was reached with his
attorney Kevin Postalwait.
The court found Hall guilty of the offense of attempted sexual assault in the second
degree, a felony, and guilty of the offense of sexual abuse in the first degree, a felony,
with some of the counts being dismissed.
He was then sentenced to the West Virginia State Penitentiary for a period of not less
that one year nor more than three years, with another sentence of one to five years,
to run consecutive.
In an action styled State of WV vs. Delbert King, the court announced to the
defendant an indictment had been returned against him. The case was ordered
continued to June 17, 2002 at 1 p.m. for arraignment. His bond was set at $10,000 to
secure his appearance in court. He was represented by F. John Oshoway.
Jeremy Ray Collins advised the court he desired to enter a plea of guilty to the
offense of conspiracy to commit burglary, a felony. A pre-sentence investigation will
be made with a report scheduled for July 29, 2002. Dennis Curry was his attorney.
