ORIGINAL STORY - A right-of-way dispute on Crummies Creek between family members is continuing to escalate, with three more participants being arrested this week.
Two of the arrests are related to allegedly firing shots toward a house Tuesday, according to a criminal complaint.
State Police arrested Shirley Carol Rush, 32, and Dixie Lynn Helmick, 33, Tuesday on four counts of wanton endangerment with firearm.
A criminal complaint filed by the State Police says that siblings at the residence of Scottie Junior Rush, 56, on Crummies Creek Rd. says that a shotgun had been fired from a hillside near their residence.
The incidents are associated with an area known as Rush Mountain.
The right-of-way dispute, which has apparently been on-going for several years, broke out during the past week or so.
An altercation Sunday sent Scottie Junior Rush to the hospital, with Christopher Travis Helmic, 21, of Orma and Jacob Matthew Harrison, 22, of Chloe being charged with misdemeanor battery.
Rush suffered a head wound and is in a Charleston hospital, reportedly suffering a heart attack.
Rush's sons told police, according to the complaint, that several family members were in the yard, including a two-year-old child, when pellets hit the house, saying they heard the shooter say "Yahoo," and heard an ATV drive away from the area.
During the investigation, State Police say a neighbor confirmed hearing shots, also saying that Shirley Carol Rush had taken a piece of equipment and removed a steel gate across the disputed driveway.
State Police arrested Charley Robert Rush, 61, of Arnoldsburg Wednesday following a complaint by Shirley Carol Rush and Dixie Lynn Helmic, who allege that he accosted them while they were riding an ATV on Crummies Creek Rd. He was charged with assault.
The criminal complaint says that Charley Robert Rush "attempted to hit them (in a vehicle)," saying "Go get your buddies now."
The arrests since the dispute erupted now totals five.
