PA SUES CONSOL COAL OVER DUNKARD CREEK FISH KILL - WV Already Settled Dumping Case

The Pa. Fish and Game Commission has sued Consol Coal for the 2009 Dunkard Creek fish kill, described as the worst fish kill in recent years.

West Virginia sued Consol for $5.5 million, but settled for $500,000, allowing Consol to continue the dumping.

Consol admitted to no wrongdoing, but did agree to some new controls.

The PA commission is seeking monetary relief for damages to natural resources and for lost recreational opportunities.
