Clay County resident Bobby Hanshaw, 32, is scheduled to be arraigned by a circuit judge in Clay after being indicted this week by a grand jury.
The grand jury handed up an indictment of first-degree murder against Hanshaw.
He was arrested in May following the shooting death of Guy Dwier near the community of Procious.
Dwier was shot at close range with a .30-.30 rifle and died instantly.
State Police say Hanshaw was mad at Dwier for allegedly stealing his ATV in 2010.
Police said at the time that the two men had previous disputes.
A trial date will be set Friday.
Clay businessman Brent Boggs was also indicted for soliciting to commit a felony, of crime or violence, attempting to escape custody, and destruction of property.
