JUDGE RULES COLLINS IS INCAPABLE - Calhoun Man Charged With Sexual Assault

Judge Thomas Evans III ruled yesterday that Russell Collins was incapable of standing trial related to the sexual assault of a six-year-old child.

Judge Evans reviewed a psychological report issued by Charleston Psychiatric Group which stated Collins functions "in the manner of a six year old child."

The report said Collins was mentally retarded and a dependent personality.

"The court agrees he cannot stand trial," and Evans further stated he was incapable of regaining competency to stand trial.

Further disposition of the case has been scheduled for March 18, when the court will decide if Collins is a danger to himself or others. Collins appeared in court with his court appointed attorney Kevin Postalwait.
