Four indictments were brought yesterday by a Calhoun County Grand Jury
for burglary, larceny and sexual assault. Judge David Nibert was presiding.
Indictments indicate a likelihood that a crime has been committed, but does
not assume guilt.
Absent was an indictment against Calhoun Magistrate Steven Johnson.
Johnson is being investigated by the State Police regarding numerous
irregularities discovered by the West Virginia Supreme Court in the former
magistrate's office. A court source said the investigation is continuing with
a presentation of the case now scheduled for May.
Calhoun prosecutor Tony Morgan has recused himself, and special
prosecutor Ron Schulenberg will be handling the case, according to Circuit
Clerk Shelia Garretson.
The following individuals have been indicted:
State of West Virginia vs. Sammy Dale Hall, sexual assault in the second
degree (2 counts) and attempted sexual assault in the second degree (1
count).
State of West Virginia vs. Jeremy Ray Collins, burglary (1 count), grand
larceny (1 count) and conspiracy to commit burglary (1 count).
State of West Virginia vs. Scotty Lynn Knight of Five Forks, burglary (1
count), grand larceny (1 count) and conspiracy to commit burglary (1
count).
State of West Virginia vs. David Scott Starkey of Grantsville, burglary (1
count), grand larceny (1 count) and conspiracy to commit burglary (1
