The ATV death toll in West Virginia has climbed to a record 49.
A North Carolina man was killed last week in Mingo County.
Bobby Kemp Edwards, 57, of Goldsboro, North Carolina, was trying to climb a steep embankment when his ATV flipped and pinned him underneath.
He was pronounced dead at the scene.
State lawmakers are looking at ATV laws they passed, including making the off-the-road ATVs legal on most of WVs hard-surfaced roads.
So far, most of the lawmakers have expressed little interest in taking "freedom of the highway" from ATV riders, saying they need to be better educated.
