BRAXTON WOMAN SUES SCHOOL SYSTEM OVER SEXUAL ASSAULT

(06/10/2006)
A Braxton County woman is suing the county Board of Education, alleging that her three-year-old daughter was sexually assaulted on a school bus in 2005.

The lawsuit was filed in Kanawha Circuit Court on Wednesday, with the state Board of Education also named in the suit.

The suit maintains that children between the ages of three and 18 were allowed to ride together back and forth from the county's Head Start program.

According to the suit, the victim's siblings, ages five and 14, were also on the bus but sitting in a separate seat when the victim was assaulted by a seven-year-old student.

The suit contends that the victim sustained permanent and disfiguring scarring, as well as pain, suffering, embarrassment, humiliation, emotional and mental distress and terror.

The lawsuit seeks unspecified punitive and compensatory damages.
