A drug case against Danny Minigh has been dismissed in Braxton County because of "double jeopardy."
A jury trial had been scheduled in Braxton Circuit Court before Judge Richard Facemire.
Minigh was arrested in Burnsville, but the case was connected to the location of a meth lab on Hog Knob Hill in Calhoun County. Charges are still pending in Calhoun.
Minigh was indicted in Braxton in October, 2004 on charges of operating or attempting to operate a clandestine drug laboratory.
Minigh's counsel Christopher Moffatt filed a motion to dismiss the
charges alleging that Minigh was charged with the same offense in both Braxton and Calhoun Counties and therefore the local prosecution would constitute double jeopardy in violation of the defendant's Constitutional rights.
The Prosecuting Attorney opposed the motion.
