A Gandeeville, Roane County woman is taking action against a bank for their continued efforts to collect money from her after she settled the debt.
She is accusing Capital One Bank of violating the Fair Debt Collection Practices Act.
Earlene West filed a lawsuit last week in US District Court in Charleston.
West alleges that Capital One acquired several charged-off credit card accounts from Providian, including her own.
She says that her account had been previously settled with a debt collector hired by Providian.
Still, West says she received numerous letters and telephone calls from Capital One and its collector to settle the debt despite having documentation to show it had been paid.
The lawsuit indicates as many as 100 consumers could join the case, making it a class-action lawsuit.
Capital One says they don't comment on pending litigation.
Capital One Bank is based in Glen Allen, Virginia, and is a subsidiary of Capital One Financial Corporation in McLean, Virginia.
