A former Mt. Zion resident Brandon Lee Rose, 20 (pictured left)was scheduled to go on trial yesterday in Calhoun Circuit Court, but the trial was postponed because of problems which arose between Calhoun Prosecutor Matt Minney and defense attorney Dennis Curry.
Rose has been charged with sexually abusing a seven-year-old.
Judge Thomas Evans III said "We must take this seriously," as he dismissed the jury, saying "A problem has come up in this case that prevents it from moving forward."
The conflict appeared to be over statements and positions taken, related to an expert witness.
Defense attorney Curry is saying a confession made by Rose is not reliable.
When Rose was brought before a Calhoun magistrate in October, 2003, Sgt. D. H. Campbell of the State Police told the court Rose gave an audio confession, after a family member complained about the activity.
Since Rose allegedly committed the offense, he was released on bond, which was revoked after "misconduct."
He is currently held in Central Regional Jail.
The case is now scheduled for trial on April 12.
Another case, State vs. Jimmy Keener, has been re-scheduled because of the illness of his attorney.
Court will continue Friday with Judge Evans presiding, including pre-trial motions related to the Christopher Cox murder case.
Also scheduled Friday is sentencing for Ronnie Rush, who has been found guilty of the Groves-Hicks murders.
Also scheduled for appearance is Adam Parsons for a plea and Michael Lee Smith for a supression hearing.
