A six-person jury found Orma resident Melvin R. Starcher guilty of driving after his
license was revoked DUI and no proof of insurance. The trial was held in the
magistrate Rick Postalwait's court yesterday in Grantsville.
A considerable time was taken seating the jury.
Starcher had been charged after he was stopped by Conservation Officer John
Apgar in November, 2002.
Apgar, being questioned by Calhoun Prosecutor Matt Minney, testified the Milo
Road traffic stop was made after he noticed Starcher's vehicle traveling at a high
rate of speed and driving reckless.
Apgar said Starcher admitted to not having a license, "but he wasn't sure about
his insurance."
The officer took Starcher to his residence to produce paperwork.
Defense attorney John Oshoway attempted to prove that officer Apgar stopped
Starcher without probable cause, saying "A police officer has to have reasonable
suspicion" a violation has happened, indicating Apgar did not.
Prosecutor Minney and Officer Apgar produced evidence Starcher's license was
suspended in the State of Ohio.
Sentencing will take place on February 17.
